Article 1. Definitions

meyba.com is operated by or on behalf of Premium Inc. Retail B.V., Piekstraat 71, 3071 EL Rotterdam, The Netherlands.

Article 2. Relevance

  1. These Conditions apply to every offer, tender and agreement between the Meyba Webshop and a Customer.
  2. The Terms and Conditions also apply to agreements with third parties engaged for delivery.
  3. These Terms apply to employees and management of the Meyba Webshop.
  4. The applicability of any customer conditions is expressly rejected.
  5. If any provision is annulled, the remaining provisions remain in force.
  6. Uncertainty of interpretation shall be resolved in the spirit of these Conditions.
  7. Situations not covered shall be assessed in the spirit of these Conditions.
  8. Failure to enforce does not imply waiver of rights.
  9. The Meyba Webshop reserves the right to amend these Conditions and website content.

Article 3. Offers and Tenders

  1. All offers and promotions are non-binding unless stated otherwise.
  2. Offers may be revoked in case of obvious errors.
  3. Prices include VAT, packaging, shipping and administration unless stated otherwise.
  4. Acceptance deviating from an offer is not binding unless confirmed.
  5. Compound offers do not obligate partial fulfillment.
  6. Promotions do not automatically apply to repeat orders.

Article 4. Order Confirmation and Agreement

  1. The Meyba Webshop reserves the right to accept or reject orders.
  2. Customers will be informed of product availability and payment is required in advance.
  3. Unavailable items may be placed on backorder; customers may refuse backorders.
  4. This agreement replaces all prior agreements.
  5. Electronic communication constitutes valid proof.

Article 5. Price

  1. The total price on the order confirmation is final.
  2. EU taxes are subject to European regulations.
  3. Invoices are sent only upon explicit request.
  4. Prices may be corrected; customers may cancel within 2 days of a price change.

Article 6. Delivery

  1. Orders are shipped via DHL or another carrier.
  2. Delivery times are indicative and non-binding.
  3. Delivery time starts once handed over to the carrier.
  4. Delayed shipments are investigated after 4 weeks.
  5. Import duties outside the EU are borne by the customer.
  6. Delivery costs are borne by the customer.
  7. The customer must accept delivery.
  8. Incorrect delivery details may incur additional costs.
  9. Shipment insurance is optional and subject to agreement.
  10. Delivery depends on correct customer-provided information.

Article 7. Warranty

Meyba products meet high quality standards. Warranty covers manufacturing and material defects only.

Warranty Conditions

  • Unfounded complaints are at the customer’s expense.
  • Meyba may repair, replace, or refund the product.
  • Returned items must be clean and dry.

Warranty Exclusions

  • Intentional damage or negligence
  • Improper use or maintenance
  • Normal wear and tear
  • Failure to follow instructions
  • Damage caused by nature, humans, or animals

Warranty Outside the Netherlands

Shipping costs for warranty claims outside the Netherlands are borne by the customer.

Article 8. Receipt

  1. Deliveries must be inspected within 48 hours.
  2. Damaged packaging must be documented and reported immediately.
  3. Returns require written approval.
  4. Return shipping costs are borne by the customer.

Article 9. Liability

  1. Liability is limited to these Terms.
  2. Warranty provisions apply to defective products.
  3. Liability is limited to replacement or refund.
  4. Customers are responsible for product use.
  5. No liability for incorrect customer information.
  6. Only direct damage due to gross negligence applies.
  7. No liability for indirect or consequential damages.
  8. Liability is limited to insurer coverage.
  9. No liability for typographical or usage errors.
  10. Limitations do not apply in case of gross negligence.

Article 10. Transfer of Risk

Risk transfers to the customer upon delivery.

Article 11. Payment

  1. No rights can be derived from incorrect prices or images.
  2. Payment must be made via offered payment methods.
  3. Customer data is protected under GDPR.

Article 12. Right to Terminate the Contract

  1. Customers may cancel within 7 working days.
  2. Products must be unused and in original packaging.
  3. Returns are the customer’s responsibility.
  4. Damaged returns will be reported within 2 working days.
  5. Accessories and clearance sales are excluded.

Article 13. Complaints

Complaints must be reported within 48 hours of receipt.

Article 14. Intellectual Property

  1. All intellectual property rights are reserved.
  2. All website content is owned or licensed by the Meyba Webshop.
  3. Use without written consent is prohibited.

Article 15. Force Majeure

  1. Neither party is liable in cases of force majeure.
  2. Force majeure includes all external uncontrollable causes.
  3. The Meyba Webshop may invoke force majeure at any time.

Article 16. Applicable Law and Disputes

  1. Dutch law applies exclusively.
  2. Parties will attempt to resolve disputes amicably first.
