Terms & Conditions
Article 1. Definitions
meyba.com is operated by or on behalf of Premium Inc. Retail B.V., Piekstraat 71, 3071 EL Rotterdam, The Netherlands.
Article 2. Relevance
- These Conditions apply to every offer, tender and agreement between the Meyba Webshop and a Customer.
- The Terms and Conditions also apply to agreements with third parties engaged for delivery.
- These Terms apply to employees and management of the Meyba Webshop.
- The applicability of any customer conditions is expressly rejected.
- If any provision is annulled, the remaining provisions remain in force.
- Uncertainty of interpretation shall be resolved in the spirit of these Conditions.
- Situations not covered shall be assessed in the spirit of these Conditions.
- Failure to enforce does not imply waiver of rights.
- The Meyba Webshop reserves the right to amend these Conditions and website content.
Article 3. Offers and Tenders
- All offers and promotions are non-binding unless stated otherwise.
- Offers may be revoked in case of obvious errors.
- Prices include VAT, packaging, shipping and administration unless stated otherwise.
- Acceptance deviating from an offer is not binding unless confirmed.
- Compound offers do not obligate partial fulfillment.
- Promotions do not automatically apply to repeat orders.
Article 4. Order Confirmation and Agreement
- The Meyba Webshop reserves the right to accept or reject orders.
- Customers will be informed of product availability and payment is required in advance.
- Unavailable items may be placed on backorder; customers may refuse backorders.
- This agreement replaces all prior agreements.
- Electronic communication constitutes valid proof.
Article 5. Price
- The total price on the order confirmation is final.
- EU taxes are subject to European regulations.
- Invoices are sent only upon explicit request.
- Prices may be corrected; customers may cancel within 2 days of a price change.
Article 6. Delivery
- Orders are shipped via DHL or another carrier.
- Delivery times are indicative and non-binding.
- Delivery time starts once handed over to the carrier.
- Delayed shipments are investigated after 4 weeks.
- Import duties outside the EU are borne by the customer.
- Delivery costs are borne by the customer.
- The customer must accept delivery.
- Incorrect delivery details may incur additional costs.
- Shipment insurance is optional and subject to agreement.
- Delivery depends on correct customer-provided information.
Article 7. Warranty
Meyba products meet high quality standards. Warranty covers manufacturing and material defects only.
Warranty Conditions
- Unfounded complaints are at the customer’s expense.
- Meyba may repair, replace, or refund the product.
- Returned items must be clean and dry.
Warranty Exclusions
- Intentional damage or negligence
- Improper use or maintenance
- Normal wear and tear
- Failure to follow instructions
- Damage caused by nature, humans, or animals
Warranty Outside the Netherlands
Shipping costs for warranty claims outside the Netherlands are borne by the customer.
Article 8. Receipt
- Deliveries must be inspected within 48 hours.
- Damaged packaging must be documented and reported immediately.
- Returns require written approval.
- Return shipping costs are borne by the customer.
Article 9. Liability
- Liability is limited to these Terms.
- Warranty provisions apply to defective products.
- Liability is limited to replacement or refund.
- Customers are responsible for product use.
- No liability for incorrect customer information.
- Only direct damage due to gross negligence applies.
- No liability for indirect or consequential damages.
- Liability is limited to insurer coverage.
- No liability for typographical or usage errors.
- Limitations do not apply in case of gross negligence.
Article 10. Transfer of Risk
Risk transfers to the customer upon delivery.
Article 11. Payment
- No rights can be derived from incorrect prices or images.
- Payment must be made via offered payment methods.
- Customer data is protected under GDPR.
Article 12. Right to Terminate the Contract
- Customers may cancel within 7 working days.
- Products must be unused and in original packaging.
- Returns are the customer’s responsibility.
- Damaged returns will be reported within 2 working days.
- Accessories and clearance sales are excluded.
Article 13. Complaints
Complaints must be reported within 48 hours of receipt.
Article 14. Intellectual Property
- All intellectual property rights are reserved.
- All website content is owned or licensed by the Meyba Webshop.
- Use without written consent is prohibited.
Article 15. Force Majeure
- Neither party is liable in cases of force majeure.
- Force majeure includes all external uncontrollable causes.
- The Meyba Webshop may invoke force majeure at any time.
Article 16. Applicable Law and Disputes
- Dutch law applies exclusively.
- Parties will attempt to resolve disputes amicably first.
